Information obligation for recruitment purposes
This information obligation specifies the privacy policy for personal data of persons wishing to participate in the recruitment process of Smulders Projects Poland Sp. z o. o. If you do not accept this Privacy Policy, you will not be able to participate in the recruitment process.
Personal data administrator

Processing purposes and legal basis
We will process your personal data in order to:
- assess your qualifications for the position you are applying for;
- assess your abilities and skills needed for the position you are applying for;
- select the right person to work for us.
With your separate consent, we will also process your data for future recruitment processes.
The legal basis for processing your personal data is:
- legal provision – Article 6(1)(c) of the GDPR, including in particular Article 221(1) of the Labour Code, including in respect of the following data: name; date of birth; contact details; education; previous employment history;
- the necessity of the processing for the conclusion of an employment contract or for pre-contractual action;
- Your consent to the processing of data provided in your CV and cover letter if you provide us with data other than: name; date of birth; contact details; education; previous employment history;
- our legitimate interest – in respect of data collected during an interview – we have a legitimate interest in checking your skills and competences, as this is necessary for us to assess whether you are a suitable person for the position for which we are recruiting; Where we process your data for the purpose of establishing or pursuing a claim or defending against a claim, your data will be processed for the duration of the proceedings and optionally for the period of the statute of limitations for claims;
- Your consent to the processing of data for future recruitment.
No obligation to provide data
Your provision of personal data is voluntary, although necessary for the recruitment process. Your failure to provide your data will prevent you from participating in the recruitment process.
Period of retention of personal data
We will keep your personal data until the recruitment for the position you are applying for has ended. If you have given separate consent for us to process your data for future recruitment purposes, we will keep your data for a period of 2 (two) years after it has been collected.
Recipients of data
We will pass on your personal data to, among others, entities within the Smulders Group (e.g. Iemants NV, Belgium) and the Eiffage Group, our suppliers to whom we outsource personal data processing services, e.g. IT service providers or accounting firms. Such entities process data on the basis of a contract with us and only in accordance with our instructions.
Your rights in relation to the processing of your personal data
You have the following rights in relation to the processing of your personal data:
(a) the right to withdraw your consent to the processing of your data (Article 7(3) GDPR),
(b) the right of access to your personal data (Article 15 GDPR),
(c) the right to request the rectification of your personal data (Article 16 GDPR),
(d) the right to request the erasure of your personal data (Article 17 GDPR),
(e) the right to request the restriction of the processing of your personal data (Article 18 GDPR),
(f) the right to object to the processing of your data on the grounds of your particular situation – in cases where we process your data on the basis of our legitimate interest,
(g) the right to portability of your personal data, i.e. the right to receive your personal data from us, in a structured, commonly used, machine-readable computer format. You can send this data to another controller or request that we send your data to another controller. However, we will only do this if such a transfer is technically possible. You only have the right to data portability in respect of the data that we process on the basis of your consent or contract.

Right to withdraw consent
To the extent that your data is processed on the basis of consent (i.e. data provided in your CV and cover letter, other than: name, date of birth; contact details; education; previous employment history or processing for future recruitment purposes) – you have the right to withdraw your consent to processing at any time. The withdrawal of consent does not affect the lawfulness of the processing carried out on the basis of your consent before its withdrawal. Right to object
To the extent that we process your data on the basis of our legitimate interest – you have the right to object to the processing on the grounds of your particular situation.
Right to lodge a complaint with an authority
You also have the right to lodge a complaint with the supervisory authority in charge of personal data protection, i.e. the President of the Data Protection Authority.
Data transfer to third countries
The Controller may exceptionally transfer personal data to processing partners outside the European Economic Area (EEA), but only to the extent necessary, related to the provision of services by these partners to the Controller or for the purpose and in connection with the internal administrative purposes of the Smulders Group. In such cases, the Controller shall ensure the protection of your personal data, in particular through the application of standard data protection clauses adopted by a decision of the European Commission or transfer to countries for which the European Commission has issued an adequacy decision. In such circumstances, you may obtain a copy of the safeguards in place by contacting the Controller (contact details indicated in section 1 above).
Automated decision-making, including profiling
We would like to inform you that we do not carry out activities involving automated decision-making, including profiling, in relation to data subjects whose personal data are processed.
